Terms of Service

These Terms of Service (“Terms”) govern your access to and use of WINK (“the Service”), an AI product imagery studio operated by WINK (“we”, “us”). By creating an account or using the Service you agree to these Terms.

1. The Service

WINK generates commercial product imagery from photos you upload: on-model try-on images, lifestyle photo sets, background replacement, upscaling and related editing tools. Generation is performed by machine-learning models; results are probabilistic and may require regeneration to meet your needs.

2. Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. We may suspend accounts that violate these Terms.

3. Credits and payment

Generation consumes credits. Purchased credits are non-transferable and, except where required by law, non-refundable once consumed. Pricing shown in the Service at the time of purchase applies.

4. Your content

You retain ownership of images you upload and must hold the rights needed to use them. You grant us a limited licence to process uploaded images solely to provide the Service. Subject to these Terms and applicable law, you may use generated images for your commercial purposes, including e-commerce listings.

5. Acceptable use

You may not use the Service to create unlawful, infringing, deceptive or harmful content; to generate imagery of real persons without their consent; or to violate the rights of any third party. We may refuse or remove content that breaches this section.

6. AI output disclaimer

Generated images are produced by AI and may contain inaccuracies or artifacts. You are responsible for reviewing outputs before commercial use, including compliance with marketplace and advertising rules that apply to you.

7. Availability and changes

We work to keep the Service available but do not guarantee uninterrupted operation. Features may change as underlying models and infrastructure evolve.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve months preceding the claim. We are not liable for indirect or consequential damages.

9. Termination

You may stop using the Service at any time. We may terminate or suspend access for material breach of these Terms. Sections that by their nature should survive termination survive it.
